2. Entry Period: The Hotel California Tequila Trip contest to give away a 4 night stay Baja, Mexico will begin 5:00PM on October 1, 2010 and ends at 11:59:59 PM (EST) on June 30th, 2011 (the “Contest Period”).
3. Eligibility: This Contest is open to legal residents of the United States. VOID IN ANY STATE OR PROVINCE WHICH DOES NOT ALLOW CONTESTS OF THIS NATURE. Entrants must be at least 21 years of age or older at time of entry. Employees, current volunteers and their immediate families (i.e. parents, spouse, children, siblings, grandparents, step parents, step children and step siblings) of Puretech Holdings, Hotel California Tequila USA, LLC, or any affiliated companies and partners are not eligible to participate in this Contest. By participating in this contest, entrants:
(a)agree to be bound by these Official Rules and by the interpretations of these Official Rules by Sipping Spirits, LLC., Hotel California Tequila USA, LLC, and by the decisions of Sipping Spirits, LLC., Hotel California Tequila USA, LLC, which are final in all matters relating to the Contest.
(b) release from liability, indemnify, defend and hold harmless any of the Contest Entities and each of their respective partners, agencies, employees, officers, directors, volunteers, communities and assigns, against any and all claims, injury or damage arising out of or relating to such entrant’s participation or inability to participate in this Contest and/or use or misuse, or redemption of or inability to redeem the prize
(c) acknowledge compliance with these Official Rules
4.To Enter: Visit The Hotel California Tequila website or any promotional event sponsored by Sipping Spirits, LLC. where enrty forms are readily available, during the Open contest Period. Entrants must also electronically acknowledge and agree to terms of Sipping Spirits, LLC.’s Privacy Policy and Terms of Use and submit the online entry form as instructed. All entries submitted in accordance with these Official Rules shall be hereinafter be referred to as the “Eligible Entries.” You may enter one time. All entries become the property of Sipping Spirits, LLC. and will not be acknowledged or returned. Entering more than once will disqualify you.
5. Winner Selection/Notification: There will be one (1) grand prize winner (“Grand Prize Winner”). On or before July 5, 2011, Sipping Spirits, LLC. will randomly select the Grand Prize Winner from all of the Eligible Entries received. Sipping Spirits, LLC. will make up to five attempts over a 7 day period following the Grand Prize Winner selection to contact the Grand Prize Winner via the email address and telephone number provided on his/her entry form. If a potential Grand Prize Winner cannot be reached during the 7 day period in which he/she is emailed and called, the potential Grand Prize Winner will be disqualified and, an alternate Grand Prize Winner will be selected at random from among all remaining applicable Eligible Entries received. The odds of winning depend on the total number of Eligible Entries received.
6. Winner Verification: The potential Grand Prize Winner must sign within 2 weeks of receipt of contest documents from Sipping Spirits, LLC.:
(a) an affidavit of eligibility and release of the Contest Entities and each of their respective partners, agencies, employees, officers, directors, volunteers, communities and assigns, against any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or other harm suffered in connect with the contest;
(b) except where prohibited by law, acceptance of the Grand Prize constitutes permission to the Sipping Spirits, LLC., Puretech Holdings, LLC, its partners and its agencies to use the winners name, likeness, and/or voice for the purpose of advertising and fundraising campaigns without further compensation (although travel costs for events which require and have been agreed upon by the Grand Prize Winner to be in attendance will be covered).
(c) Grand Prize Winner must also complete any additional legal documents (i.e. travel visa to Mexico, medical health documents, etc.) relating to the Grand Prize.
7. Grand Prize: The Grand Prize Winner will receive a 3 night trip for two (2) to Hotel California in Baja, Mexico. Included in the Grand Prize basic lodging in the Hotel, roundtrip ground transportation to and from airport in Baja.
Grand Prize Winner will be responsible for costs related to travel and layovers on the way to/from Mexico, souvenirs, alcoholic beverages (exept Hotel California Tequila - based cocktails on Hotel Property), including airfare and other incidentals. Sipping Spirits, LLC. recommends the Grand Prize Winner to carry about $300‐$500 to cover these expenses.
The approximate value (the “AV”) of the Grand Prize is $2,200. The AV is subject to change based on currency exchange rates and market conditions at the time of the Grand Prize fulfillment and the time of travel and the distance between departure and destination. Any difference between the AV and the actual value, if any, will not be awarded. Arrangements for the fulfillment of the Grand Prize, with exception to air travel arrangements, will be made by Sipping Spirits, LLC.. The dates for the fulfillment of the Grand Prize will be between June 1st, 2010 to August 20th, 2010.
If a potential Grand Prize Winner is not available to travel on the dates outlined by Sipping Spirits, LLC., such potential Grand Prize Winner could be disqualified and an alternative potential Grand Prize Winner will be selected randomly from all remaining applicable Eligible Entries if time permits in Sipping Spirits, LLC.’s sole discretion. Sipping Spirits, LLC. will determine the lodging facilities and other modes of transportation (air travel is the sole responsibility of the Grand Prize Winner). The Grand Prize Winner must possess a valid US Passport in order to travel. All travelers must execute all required releases and documents specified in these Official Rules prior to ticketing.
8. General Prize Terms: All costs and expenses not specifically listed above, including, without limitation alcoholic beverages, snacks, entertainment, souvenirs, baggage fees are solely the Grand Prize Winner’s responsibility. Upon entry into the Contest, the Grand Prize Winner (as well as all other entrants) is required to comply with any and all applicable federal, province, and local laws, rules and regulations.
No substitution, transfer or cash equivalent of the Grand Prize or any portion thereof permitted.
9.General Terms: Noncompliance with any of these Official Rules may result in disqualification. ANY VIOLATION OF THESE OFFICIAL RULES BY A GRAND PRIZE WINNER OR ANY BEHAVIOR BY A GRAND PRIZE WINNER THAT WILL BRING HOTEL CALIFORNIA TEQUILA, USA OR ITS PARTNERS AND THE CONTEST ENTITIES INTO DISREPUTE WILL RESULT IN SUCH GRAND PRIZE WINNER’S DISQUALIFICATION AND ALL PRIVILEGES AS A GRAND PRIZE WINNER WILL BE IMMEDIATELY TERMINATED.
